Part 1: Modern technology and AI: What Japanese companies can expect when negotiating with government agencies
This talk will focus on emerging technologies and AI, and will address hot topics and common themes as companies around the world engage in investigations and litigation with the Department of Justice, Federal Trade Commission, and other U.S. government agencies. As examples, we discuss the complexities of investigations and litigation related to AI, mobile devices, text messaging, ephemeral messaging, eDiscovery protocols, confidentiality orders, emerging technology policies, and more. We also discuss written guidance from law enforcement authorities that can help Japanese companies and companies from other countries understand what is expected of them in this area. This guidance includes, for example, the U.S. Department of Justice's latest 2023 guidance on how to evaluate a company's compliance programs regarding mobile devices, communication platforms, and ephemeral messages.

Part 2: Crisis management/risk management and digital transformation (DX) of Japanese companies
~DX promotion as a management issue from the perspective of risk management~
Is digital transformation (DX) progressing smoothly at your company? When I am in charge of fraud investigations and compliance matters, I often feel that, if DX was more implemented and companies had a better understanding of where and what kind of documents and data existed in the companies, it could have been possible to take actions earlier before a bigger problem occurred.
As for trends among Japanese authorities, I can point to the National Tax Agency (the “NTA”)'s direction to drive DX forward in tax administration. In 2021, the NTA presented its ideas on the direction in which procedures and operations related to national taxation should take in the DX era, and in June 2023, the NTA released "Digital Transformation of Tax Administration - Future Vision of Tax Administration 6”, outlining the details of the digital transformation. The theme of "more efficient and sophisticated taxation and collection administration (thorough use of data)" is expected to have a significant impact on businesses in the future, in conjunction with the promotion of digital invoicing under the so-called "invoice system" that has just been implemented in October 2023.
As a lecturer, I will explain how DX promotion has become an urgent issue for Japanese companies.
