The latest trends in CFIUS reviews changing with the rise of conservatism - Based on recent cases
Arguments that border walls should be built, domestic industries should be protected, and immigrants should be excluded are visibly emerging in the United States and Europe. The idea of drawing a line at globalization, which emphasizes market integrity, is visibly on the rise, and is beginning to affect the policies of U.S. authorities. The CFIUS review is the most prominent example of this, and it is becoming a major issue that cannot be avoided by Japanese companies considering investing in the U.S. These days, passing the CFIUS review is becoming the key to successful M&A to acquire U.S. companies, along with approval from the antitrust authorities. In light of this situation, this webinar will provide an overview of the CFIUS system as a whole, and will also analyze substantive and procedural legal issues based on recent cases.
