Technology has evolved rapidly in recent years. In particular, generative AI is one of the technologies that is attracting attention and is being actively used in people's lives. Although generative AI brings benefits such as increased productivity, it may also create barriers to entry for new entrants by establishing a strong advantage for certain companies that already have extensive access to data sets, creating a barrier to entry for new entrants. may cause concern. Additionally, the issue of digital cartels (whether cartels conducted by or through AI violate competition law) continues to be a subject of debate.

Governments and competition authorities around the world are discussing and attempting to address competition law concerns in the digital space, including generative AI. Last November, the Fair Trade Commission, in collaboration with the Cabinet Secretariat Digital Market Competition Headquarters Secretariat, held the G11 Enforcers and Policy Makers Summit in Tokyo. In addition to competition authorities from the G7 countries, competition authorities from Australia, India, South Korea and South Africa also participated.

In the first part of this seminar, we will first provide an overview of global trends, and then introduce the current situation and new trends in the EU and the UK. In Europe, AI is already subject to scrutiny by competition authorities. In addition to the European Commission, some competition authorities in EU member states have also launched investigations into the impact of AI on competition. There is also the issue of BigTech's AI partnerships, which the UK Competition Authority (CMA) and the European Commission have already begun to scrutinize. The EU's AI law, expected to be adopted by April 1, could provide a new gateway for antitrust enforcement. We also discuss recent developments in Australia, including the government's proposed approach to regulating AI and the areas competition authorities may focus on.
