Part 1 Modern technology and AI: What Japanese companies can expect when negotiating with government agencies

Focusing on emerging technology and AI, we cover hot topics and common themes as companies around the world engage in investigations and litigation with the U.S. Department of Justice, Federal Trade Commission, and other U.S. government agencies. As examples, we discuss the complexities of investigations and litigation related to AI, mobile devices, text messaging, ephemeral messaging, eDiscovery protocols, confidentiality orders, emerging technology policies, and more. We will also discuss written guidance from law enforcement authorities to help Japanese companies and those from other countries understand what is expected of them in this area. This guidance includes, for example, the U.S. Department of Justice's latest 2023 guidance on how to evaluate a company's compliance programs regarding mobile devices, communication platforms, and ephemeral messages.

Part2 Crisis management/risk management and digital transformation (DX) of Japanese companies
    ~DX promotion as a management issue from the perspective of risk management~

Is digital transformation (DX) progressing smoothly at your company? When I was in charge of fraud investigations and compliance matters, I realized that if I had been able to promote DX and know in advance what kind of materials and data were located within the company, I would have been able to deal with them sooner before they became a major problem. I often feel that this may be the case. Furthermore, as a trend among Japanese authorities, we can point out the National Tax Agency's promotion of DX in tax administration. In 2021, the National Tax Agency has indicated its approach regarding the direction in which national tax-related procedures and operations will be aimed in the DX era. The future image of public administration 2023 was announced and details were presented. Among these, the theme of "Improving the efficiency and sophistication of taxation and collection operations <Thorough utilization of data>" is also the theme of promoting the spread of digital invoices through the so-called "invoice system" that was launched in October 6. Together, these are likely to have a significant impact on companies going forward. As a lecturer, I will explain how DX promotion has become an urgent issue for Japanese companies.
